It is not uncommon that disputes and claims arise in Engineering Construction & Building (ECB) projects that can involve PEs, Engineers, Employers, Contractors and other stakeholders. Instead of rushing to the court or arbitration panel to resolve the disputes and claims, which can be costly and time consuming, the parties involved should give serious thoughts to settle their claims & disputes amicably through Mediation and other alternative dispute resolution (ADR), which are inexpensive and faster. Objectives:

To share with the participants a cheaper and faster way to settle their claims & disputes (which they often encounter in carrying out their contractual works or projects) amicably through Mediation and other alternative dispute resolution (ADR) and how to go about it.

 

Course Outline:

1. A short introduction on the laws of Singapore;

 

2. What is Mediation, what takes place in a Mediation and how it works to help parties resolve their disputes & claims amicably;

 

3. What is ADR and how it too can help parties settle their disputes & claims amicably;

 

4. Compare and contrast Mediation with other ADR and with formal resolution process through litigation and arbitration;

 

5. How to ensure that amicable settlement of the parties’ disputes & claims through Mediation and other ADR is binding;

 

6. Case study of a dispute that was resolved through Mediation;

 

7. Role play by participants in a Mediation process.

 

Trainer’s CV:

Mr. Lee Kwok Weng, B.Eng. (Mech.)(S'pore), M.Sc.(Ind.Eng)(NUS), DipBA(NUS), GradDip Mktg.(MIS), LLB(Hons)(Bucks), LLM(Lond), Barrister-at-Law, Advocate & Solicitor (Retired), Supreme Court of Singapore, MMIS, FIES, Honorary Legal Advisor, IES & SISO, a senior lawyer, was in continuous private legal practice for almost 29 years running his own law firm before his retirement from legal practice.

 

He is a trained practising Mediator and had been a Principal Mediator on the panel of the Singapore Mediation Centre for many years before he stepped down to conduct private mediation. Mr. Lee is also an accredited Arbitrator.

 

A well sought after speaker & trainer, Mr. Lee teaches law & related subjects in a number of tertiary institutions. He has been for many years an Adjunct Associate Professor at the Faculty of Business Admin, National University of Singapore, teaching Business Law in the MBA programme as well as an Adjunct Lecturer in NTU & BCA Academy. He specialises in Business Contracts, Negligence, Safety, Environmental, Information Technology and Engineering, Construction & Building Laws. He is a very experienced lecturer and trainer and is well-versed in the technical field, marketing and management practice too.

 

 

Mr. Lee brings with him considerable experience as a Mediator having mediated in many commercial disputes and as a Negotiator in negotiating commercial and business dealings. He also brings with him vast industrial project and business development management experience, having worked for more than 12 years (before he switched to the law profession) in the public & private sectors, first working as a project engineer with the Singapore Government Ministry and eventually as a senior project manager in a leading Multi-national engineering and construction corporation serving the energy, oil and gas industries onshore and offshore.
