Course outline: |
Day 1 - Introduction to classification of law, common law and statute law and judicial precedents. - Formalities and formation of a valid contract - Terms of contract - Privity of contract and vitiating factors (e.g. misrepresentation, duress) - Illegal contracts and discharge of contracts (through agreement, frustration, etc) - Breach of contract, available remedies, provision of liquidated damages - Introduction to the Law of Tort - Tort of Negligence and its elements - The impact of the Law of Negligence on qualified persons, PEs, engineers, etc.
Day 2 - Engineers and the Law of Negligence misstatement - Overview of Technical Legislations affecting qualified persons, PEs, technical professionals, consultants, mangers, contractors, etc. => Workplace Safety & Health Act => Immigration Act (relating to employment of illegal immigrant) => Employment of Foreign Manpower Act (relating to employment of foreigner without valid work pass) => Building Control Act => Professional Engineers Act & rules of ethics - An overview of Criminal Laws & their relevance to qualified persons, Professional Engineers, engineers, consultants, managers, business owners and contractors - Difference between criminal and civil liabilities - Sources of our criminal laws and elements of crime - A review of the Penal Code, Criminal Law Act, Criminal Procedure Code and offences/criminal liabilities under various technical legislations like Workplace Safety Health Act, Building Control Act, PE Act and their related regulations - Possible criminal liabilities of qualified persons, PEs, engineers, consultants, managers, business owners and contractors

LLM(Lond), Barrister-at-Law, Advocate & Solicitor (Retired), Supreme
Court of Singapore, Accredited Arbitrator & Mediator, MMIS,
FIES, Honorary Legal Advisor, IES & SISO, a senior lawyer, was in continuous
private legal practice for almost 29 years running his own law firm before
his retirement from legal practice. He has been for many years an Adjunct Associate Professor at the
Faculty of Business Admin, National University of Singapore, teaching
Business Law in the MBA programme.. He specialises in Business Contracts,
Negligence, Information Technology and Engineering & Building Laws. He
was also an Adjunct Lecturer with NTU & BCA Academy for many years. He is
a very experienced lecturer and trainer and is well-versed in the technical
field, marketing and management practice too. Mr.Lee brings with him considerable industrial project and
business development management experience, having worked for many years as a
senior project manager in a leading Multi-national engineering and
construction corporation serving the energy, marine, oil and gas industries
onshore and offshore. A knowledge lawyer himself, Mr.Lee also brings with him a wealth of practical knowledge & experience of the legal requirements, setting & starting and managing businesses in the knowledge economy as he is a co-founder of and legal/corporate adviser to some IT/internet & other companies. |
