 Legal Aspects of Design for Safety in Buildings & Structures (Rerun 54)

 

WSH (Design for Safety) Regulations (DfS) which comes into effect on 1 August 2016 covers projects undertaken by a developer in the course of business that involves development with construction work with contract value $10M and above.

Owners, Developers, Engineers, Designers & Contractors (parties involved in such building, structure & construction projects) will have to comply with these safety rules since under DfS, they will have to incorporate safety features into design plans to protect workers who build and maintain the projects.

It is therefore crucial for PEs, Engineers, Developers, Owners of Projects, Technical Professionals & Contractors and other stakeholders to understand the framework and process in Design for Safety in Buildings & Structures and to familiarise with the guidelines to review the design for safety & health risks, their legal duties and possible liabilities, which this course will discuss.

1      Workplace Safety and Health Act (WSH) and WSH (DfS) Regulations, the difference and how they are related.’

2      Why the need to introduce DfS rules.

 

3      Projects and Developments that are covered by the DfS Regulations

4      The key provisions of DfS Regulations

 

5      Duties of the Developer include eliminating design risks, ensuring competency of designers & contractors engaged

  and that they have sufficient time & resources to perform their duties, providing relevant information to them,

  convening DfS review meetings and setting up DfS register.

 

6      Who are the appointed designers & what are their duties?

 

7      Duties of the Contractor include hiring competent designers & subcontractors and  providing all relevant information

  to the designers & subcontractors appointed by the Contractor.

 

8      Duties of Current Owner when disposing or selling Structure or Building to New Owner  as well as duties of New Owner and duties

  of Subsidiary Management Corporation in the case of sub-divided buildings.

 

9      A brief overview of relevant criminal law

 

10   Offences & criminal liabilities of all duty holders under the DfS regulations

 

11    An outline of other possible legal liabilities of duty holders

 

12   Pointers to contain or reduce possible legal liabilities such as using the GUIDE process,etc

Trainer’s CV:

Mr.Lee Kwok Weng, B.Eng. (Mech.)(S'pore), M.Sc.(Ind.Eng)(NUS), DipBA(NUS), GradDip Mktg.(MIS), LLB(Hons)(Bucks), LLM(Lond), Barrister-at-Law, Advocate & Solicitor (Retired), Supreme Court of Singapore, Accredited Arbitrator & Mediator, MMIS, FIES, Honorary Legal Advisor, IES & SISO, a senior lawyer, was in continuous private legal practice for almost 29 years running his own law firm before his retirement from legal practice.

 

A well sought after speaker & trainer, Mr. Lee teaches law & related subjects in a number of tertiary institutions. He has been for many years an Adjunct Associate Professor at the Faculty of Business Admin, National University of Singapore, teaching Business Law in the MBA programme as well as Adjunct Lecturer in NTU & BCA Academy. He specialises in Business Contracts, Negligence, Safety, Environmental, Information Technology and Engineering, Construction & Building Laws. He is a very experienced lecturer and trainer and is well-versed in the technical field, marketing and management practice too.

 

Mr. Lee brings with him considerable experience as a Negotiator in negotiating commercial and business dealings as well as a Mediator having mediated in many commercial disputes. He also brings with him vast industrial project and business development management experience, having worked for more than 12 years as a designer & project engineer/manager in the public & private sectors. Eventually before his switch to the legal profession, Mr. Lee worked as Designer & Senior Project Manager in a leading Multi-national engineering and construction corporation serving the energy, marine, oil and gas industries onshore and offshore.
